Supreme Court Upholds Same-Sex Marriage in Five States

On Monday October 6th, the Supreme Court decided not to hear arguments appealing recent decisions overturning same-sex marriage bans in Indiana, Oklahoma, Utah, Virginia and Wisconsin. By failing to intervene, lower court decisions will remain intact, allowing same sex marriage to resume in the five states.
Firms with employees in any of these states should be prepared to handle HR and benefit obligations associated with the addition of a same-sex spouse. For example, if a firm provides coverage for an employee’s spouse, they would be obligated to provide the same coverage for a same-sex spouse.
