New Resource Guide to Leave and Disability

Recently, the Equal Employment Opportunity Commission (EEOC) released a new resource document that provides guidance on the rights of individuals with disabilities who need leave as a reasonable accommodation under the Americans with Disabilities Act of 1990 (ADA).
The new docment, titled “Employer-Provided Leave and the Americans with Disabilities Act” was created to help employers in evaluating leave under the ADA and to prevent discriminatory denials of leave. This document does not constitute new policy on the part of the EEOC, but rather clarifies existing policies and how they relate to requests for leave as reasonable accomodations. The guidance was provided because the EEOC has observed a trend of employer policies that deny or otherwise restrict the use of leave as a reasonable accommodation leave.
